MARTA DOMINGUEZ SUSPENIDA POR 3 AÑOS

El Tribunal de Arbitraje Deportivo (CAS) ha
encontrado a la española mediofondista Marta Domínguez Azpeleta culpable de una violación de las reglas anti-dopaje y su sancionado con un período de tres años de inhabilitación siguientes anomalías en su Atleta Pasaporte Biológico (ABP).
En marzo de 2013, la Asociación Internacional de Federaciones de Atletismo (IAAF) informó a la española Federación de Atletismo (RFEA) de las variaciones atípicas en ABP de la señora Domínguez e invitó al atleta explicar las anomalías detectadas en conformidad con el Reglamento Antidopaje de la IAAF. Las explicaciones dadas por la Sra Domínguez y la RFEA fueron analizados por un panel de expertos que concluyó que la existencia de tales anormalidades muy probable demostró que el atleta había utilizado una sustancia o método prohibido. Sobre la base de este hallazgo, en julio de 2013, la IAAF informó a la Sra Domínguez de su suspensión provisional inmediata, que una sanción de cuatro años sería impuesta por circunstancias agravantes, y de su derecho a solicitar una audiencia.
En febrero de 2014, un audiencia fue celebrada ante la Comisión Disciplinaria de la RFEA Deportes en Madrid, España, que absolvió Sra. Domínguez y levantó la suspensión (la Decisión RFEA). En abril de 2014, la IAAF presentó un recurso contra la Decisión de la RFEA, y en mayo de 2014, la Agencia Mundial Antidopaje (WADA) también presentó su propio atractivo. Los dos procedimientos se consolidaron y se hace referencia al mismo panel de árbitros del CAS: Sr. Conny Jörneklint, Suecia (Presidente), Sr. Romano Subiotto QC, Bélgica / Reino Unido, y el Sr. Jacques Radoux, Luxemburgo.
En sus llamamientos a la CAS, la IAAF y la AMA argumentaron que el Grupo Especial debe dejar de lado la RFEA Decisión y encontrar el atleta culpable de una violación de las reglas antidopaje y que debería imponer un período de inhabilitación de hasta cuatro años en ella. Los apelantes proporcionan evidencia científica de expertos testigos para demostrar que las explicaciones dadas por las anomalías no pueden ser Arbitral du Sport Court de Tribunal Arbitraje Deportivo.
El atleta, por su parte, argumentó que el CAS no tenía jurisdicción para decidir el asunto y disputado las pruebas científicas presentadas por la AMA y la IAAF. El Grupo Especial sostuvo una audiencia el 24 y 25 de junio de 2015 a la sede de la CAS en Lausana, Suiza, durante el cual las partes, se escucharon sus representantes legales y testigos.
El Laudo Arbitral de 99 página, que fue notificada a las partes hoy en día, el Grupo Especial constató que tenía competente para conocer de las apelaciones de la IAAF y la AMA sobre la base de reglas de la IAAF 42.3 y 42.5.
El Grupo Especial pasó a analizar los extensos argumentos presentados por las partes en relación con los valores en disputa en ABP de la Sra. Domínguez Al hacerlo, el Grupo Especial constató que ninguna de las explicaciones ofrecido por la RFEA o Marta Domínguez fueron suficiente para que el Grupo Especial no esta cómodamente satisfechos por la evidencia científica presentada por la AMA y los expertos de la IAAF de que una norma antidopaje se había producido violación. En consecuencia, el Grupo anuló la Decisión RFEA y encontró la Sra Domínguez culpable de una violación de las reglas antidopaje.
Con respecto a la sanción, el Grupo Especial constató que un período de tres años de inhabilitación era apropiado. La suspensión comenzó el 24 de junio de 2015, con el período de suspensión provisional (08 de julio 2013 hasta el 19 de marzo 2014) acreditado contra el período de inhabilitación para ser servido.
El Grupo también ordenó que todos los resultados competitivos obtenidos por la Sra Domínguez de 05 de agosto 2009 (fecha de la primera de varias colecciones de muestras) hasta el 08 de julio 2013 (inicio de la provisional suspensión) será descalificado.
El laudo arbitral será publicado en el sitio web de CAS en las próximas semanas.

MARTA DOMINGUEZ BANNED FOR 3 YEARS
BY THE COURT OF ARBITRATION FOR SPORT (CAS)
Lausanne, 19 November 2015 – A Court of Arbitration for Sport (CAS) Panel has found the Spanish middle-distance runner Marta Dominguez Azpeleta guilty of an anti-doping rule violation and sanctioned her with a three-year period of ineligibility following abnormalities in her Athlete Biological Passport (ABP).
In March 2013, the International Association of Athletics Federations (IAAF) informed the Spanish Athletics Federation (RFEA) of atypical variations in Ms Dominguez’s ABP and invited the athlete to explain the detected abnormalities in accordance with the IAAF Anti-Doping Regulations. The explanations provided by Ms Dominguez and the RFEA were analysed by an expert panel which concluded that the existence of such abnormalities highly likely demonstrated that the athlete had used a prohibited substance or prohibited method. On the basis of this finding, in July 2013, the IAAF informed Ms Dominguez of her immediate provisional suspension, that a four-year sanction would be imposed due to aggravating circumstances, and of her right to request a hearing. In February 2014, a hearing was held before the RFEA Sports Disciplinary Committee in Madrid, Spain, which acquitted Ms Dominguez and lifted her suspension (the RFEA Decision).
In April 2014, the IAAF filed an appeal against the RFEA Decision, and in May 2014, the World Anti- Doping Agency (WADA) also filed its own appeal. The two procedures were consolidated and referred to the same panel of CAS arbitrators: Mr Conny Jörneklint, Sweden (President), Mr Romano Subiotto QC, Belgium/UK, and Mr Jacques Radoux, Luxembourg.
In their appeals to the CAS, the IAAF and WADA argued that the Panel should set aside the RFEA Decision and find the athlete guilty of an anti-doping rule violation and that it should impose a period of ineligibility of up to four years on her. The Appellants provided scientific evidence from expert witnesses in order to demonstrate that the explanations provided for the abnormalities could nupheld. The athlete, on the other hand, argued that CAS did not have jurisdiction to decide the matter and disputed the scientific evidence put forward by WADA and the IAAF.
The Panel held a hearing on 24 and 25 June 2015 at the CAS headquarters in Lausanne, Switzerland, during which the parties, their legal representatives and witnesses were heard. In a 99 page Arbitral Award which was notified to the parties today, the Panel found that it did have jurisdiction to hear the appeals of the IAAF and WADA on the basis of IAAF Rules 42.3 and 42.5.
The Panel then went on to analyse the extensive arguments put forward by the parties in relation to the disputed values in Ms Dominguez’s ABP. In doing so, the Panel found that none of the explanations offered by the RFEA or Marta Dominguez were sufficient for the Panel not to be comfortably satisfied by the scientific evidence presented by WADA and the IAAF’s experts that an anti-doping rule violation had occurred. Accordingly, the Panel set aside the RFEA Decision and found Ms Dominguez guilty of an anti-doping rule violation.
With respect to the sanction, the Panel found that a three-year period of ineligibility was appropriate. The suspension commenced on 24 June 2015, with the period of provisional suspension (8 July 2013 until 19 March 2014) credited against the period of ineligibility to be served.
The Panel also ordered that all competitive results obtained by Ms Dominguez from 5 August 2009 (date of the first of several sample collections) until 8 July 2013 (commencement of provisional suspension) be disqualified.
The Arbitral Award will be published on the CAS website in the coming weeks.
